Data Retention: Clinical records are retained for 7 years following your last appointment (as required by medical regulations). You may request early deletion after 2 years of inactivity.

Agreement

Terms of Service

Effective date: January 1, 2026. Please read carefully before booking any clinical service.

1. Acceptance of Terms

By accessing the AdvancedEarCares website ("Site") or booking any clinical service, you agree to be bound by these Terms of Service ("Terms"). If you disagree with any portion, please refrain from using our services.

These Terms constitute a legally binding agreement between you ("Patient," "you," "your") and AdvancedEarCares ("Clinic," "we," "us," "our").

2. Clinical Services & Scope

Services Provided: Auditory mapping, microsuction ear cleaning, tinnitus retraining therapy, vestibular balance assessment, hearing diagnostics, and related auditory wellness procedures.

Medical Disclaimer: Our audiologists are licensed healthcare professionals. However, information provided on this Site is for educational purposes and does not replace in-person medical evaluation. Results vary by individual.

Referral Policy: If our assessment reveals conditions outside our scope (e.g., otological tumors, sudden hearing loss), we will provide a written referral to an ENT specialist within 48 hours.

3. Appointment Booking & Cancellation

Booking Confirmation: Appointments are confirmed upon receipt of deposit (if required) or insurance pre-authorization. You will receive email and SMS confirmation within 4 hours.

Cancellation Policy: Cancellations require 48 hours' written notice (email to appointments@advancedearcares.com). Late cancellations (less than 48 hours) incur a £75 fee to cover chamber recalibration costs.

No-Show Policy: Failure to attend without notice results in forfeiture of deposit or a £125 no-show fee for first offense. Repeated no-shows (3+ occurrences) may result in refusal of future service.

Late Arrival: If you arrive more than 15 minutes late, we may need to reschedule or shorten your appointment to accommodate subsequent patients. Full fees still apply.

4. Fees & Payment

Service Fees: Current fee schedule is available upon booking. Initial consultation fees range from £250-£450 depending on service complexity.

Payment Methods: We accept Visa, Mastercard, American Express, bank transfer, and major health insurance plans (see approved providers below).

Insurance: We submit claims to Bupa, AXA PPP, Vitality, and Cigna on your behalf. You remain responsible for any uncovered balances.

Refund Policy: Clinical services are non-refundable once performed. If we cancel your appointment due to clinic error (equipment failure, staff illness), we will reschedule at no cost plus a £50 inconvenience credit.

5. Patient Responsibilities & Consent

✓ Provide accurate medical history, including all medications, allergies, and prior ear surgeries

✓ Disclose any contraindications (e.g., perforated eardrum, active ear infection, cochlear implant)

✓ Follow pre-procedure instructions (e.g., ear drops before microsuction)

✓ Sign informed consent forms before each clinical procedure

✓ Communicate any discomfort, dizziness, or unexpected symptoms during or after treatment

✗ Do not drive for 2 hours following vestibular therapy that may induce vertigo

6. Liability & Waiver

Standard of Care: Our audiologists practice within established clinical guidelines. However, no medical procedure is risk-free. Potential risks include temporary dizziness, minor ear canal abrasion, tinnitus spike (rare, subsides within 72 hours), or incomplete symptom resolution.

Limitation of Liability: To the maximum extent permitted by law, AdvancedEarCares liability for any claim arising from clinical services is limited to the total fees paid by you in the 12 months preceding the claim.

Force Majeure: We are not liable for delays or cancellations caused by events beyond reasonable control (natural disasters, pandemics, government restrictions, power outages).

7. Telehealth & Remote Services

For follow-up consultations and tinnitus counseling, we offer secure video visits via our HIPAA/GDPR-compliant platform. Telehealth services require:
- Stable internet connection with 2 Mbps minimum
- Private, well-lit environment
- Headphones or external speakers for sound assessments
Remote tinnitus retraining does not replace in-person microsuction or vestibular therapy.

8. Intellectual Property

All content on this Site — including text, graphics, logos, audio protocols, and proprietary frequency mapping algorithms — is the exclusive property of AdvancedEarCares. You may not reproduce, distribute, modify, or create derivative works without written permission. Personal use printing of your own auditory reports is permitted.

9. Dispute Resolution & Governing Law

Informal Resolution: Please contact our Patient Relations team at feedback@advancedearcares.com within 30 days of any incident. We will respond within 14 business days.

Arbitration: Disputes not resolved informally shall be submitted to binding arbitration under the UK Arbitration Act 1996, administered by the Centre for Effective Dispute Resolution (CEDR), with hearings held in London.

Governing Law: These Terms are governed by the laws of England and Wales. Any legal action must be filed within one year of the claim arising.

10. Termination of Services

We reserve the right to refuse or discontinue service to any patient who:
- Provides fraudulent information
- Engages in abusive, threatening, or violent behavior toward staff
- Fails to pay outstanding balances for more than 90 days
- Misuses clinical equipment or telemedicine platforms
Termination will be communicated in writing, and emergency referrals will be provided for ongoing medical needs.

11. Entire Agreement

These Terms constitute the complete agreement between you and AdvancedEarCares, superseding all prior communications. If any provision is found unenforceable, the remaining provisions remain in full force.
